Users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978.

These conditions of sale are concluded on the one hand by the above-named company, hereinafter referred to as “seller” or “Onamaste”, and on the other hand, by any natural or legal person wishing to make a purchase via the website , hereinafter referred to as “buyer”.

Object

These conditions of sale aim to define the contractual relations between the seller and the buyer, as well as the conditions applicable to any purchase made through the merchant site www.onamaste.com, whether the buyer is a professional or an individual.

The acquisition of an item through this site implies unreserved acceptance by the buyer of these conditions of sale. These conditions of sale will prevail over any other general or specific conditions not expressly approved by the seller.

Onamaste reserves the right to modify these conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Property

The texts and photographs presented on the site are reserved under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited without the formal agreement of Onamaste.

Any establishment of hypertext links to the site without express authorization from the legal representative of the company is strictly prohibited.

Availability

Onamaste strives to communicate the most accurate availability information possible. Delivery times displayed on products currently being restocked are subject to change without notice and essentially depend on information collected from suppliers. The availability displayed on the site is given for information purposes only and does not in any way represent a contractual commitment.

Prices

The prices of products sold on the website are indicated in euros, all taxes included, excluding preparation and shipping costs. The prices of the items appearing in the catalog at the time of the order will be the only ones applicable to the buyer. These prices do not include order processing, transport and delivery costs. These costs are the responsibility of the buyer and are invoiced at the end of the order in addition to the products ordered. Price promotions displayed on the website, communicated in the press, offered by e-mail to people subscribed to the Newsletter or published by various partners, are valid for the period indicated. Certain price promotions may be subject to promotional codes. These promotional codes cannot be combined and are not refundable. For the buyer to benefit from them, it is mandatory to enter them in the box reserved for this purpose when validating the order.

Orders

The buyer who wishes to purchase a product must:

• complete all requested contact details;
• confirm your order after checking it;
• make payment under the stipulated conditions;

Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and renunciation of relying on one's own conditions of purchase or other conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. The seller will communicate by email confirmation of the registered order.

For security reasons and in order to protect our customers against possible credit card fraud, all orders are subject to verification. Additional information may be requested from the buyer to validate their purchase.

Delivery

A shipping date is indicated before order confirmation. This takes into account the availability and/or current restocking of the product. Depending on the carrier chosen, a delivery time is communicated to the buyer. If the delivery date is exceeded by 14 days and not due to a case of force majeure, the buyer can cancel their order by registered letter with acknowledgment of receipt. The order is considered canceled upon receipt of the letter by Onamaste. The buyer exercises this right for 60 days from the scheduled delivery date. In this case, the order will be refunded within a maximum of 14 days.

Any partial delivery, required by the buyer, of an order containing products unavailable on the agreed delivery date, generates additional costs payable by the buyer.

In the event of loss or non-receipt of the package, the buyer, provided with their tracking number received by e-mail, must notify the carrier of the non-receipt of their order and inform Onamaste. An investigation is carried out with the carrier and may take several days. During this period, no refunds or returns can be made. After confirmation of the loss of the package by the carrier, the buyer will benefit from a refund of their purchase or reshipment of their order.

In the event of damage during transport, it is the buyer's responsibility to fill out a claim file with the carrier and return the item to us. Onamaste initiates a claim with the carrier and reimburses the buyer within 14 days, if the buyer's claim is properly registered with the carrier.

Pre-order

A pre-order consists of ordering an article which is not yet available but whose publication is imminent (less than two months). Your order will only be shipped once all products are available. If you wish to receive immediately available products more quickly, you will need to place two separate orders. Your payment is collected as soon as the pre-order is placed on our website. Your pre-order can be canceled during the first 14 days after your pre-order and you will be fully refunded as an order cancellation. After 14 days, you will receive a voucher if you no longer want the pre-ordered item. The “pre-order” is a priority reservation on a product which allows you, as soon as it is available, to be delivered as a priority.

Payment

To pay for their order, the buyer has their choice of all the payment methods indicated after validation of the basket. The buyer guarantees to the seller that he has the necessary authorizations to use the payment method chosen when validating the order form.

The part dedicated to online payment of the website is subject to a security system (SSL encryption). Bank cards are debited on the same day the order is prepared and not upon validation of the order by the buyer. In the event of refusal of a transaction by the payment centers, the seller reserves the right to suspend the corresponding orders. The buyer will be notified by e-mail or telephone and must contact their bank to unblock the transaction.

Receipt and return - withdrawal

For any distance purchase (mail order sale), the buyer has a period of fourteen clear days from the date on which the distance contract is concluded to exercise his right of withdrawal without having to justify reasons or to pay penalties, with the exception, where applicable, of return costs (art. L 121 of the Consumer Code).

The product must be returned in protected packaging so that it does not suffer any damage and remains marketable (return costs and risks borne by the buyer). If this is not the case, Onamaste reserves the right to refuse the processing of these products. No refund or credit can be made if the product packaging has been opened. If you wish, the product will be returned to you at your expense.

Outside of the withdrawal period, administration, handling and delivery costs are not refundable.

Guarantee

All items are subject to a legal guarantee of conformity (L211-1 of the Consumer Code) and a guarantee against hidden defects (articles 1641 et seq. of the Civil Code), allowing the buyer to return defective items delivered.

Excluded from the scope of the warranty are defects and deterioration caused by wear, by an external accident (for example, faulty maintenance, shock, lightning, etc.), by use or installation not in accordance with specifications. and the manufacturer's recommendations.

For any return under warranty, shipping is the responsibility of the customer and at their risk. Exchange costs are the responsibility of the seller in mainland France.

Protective films are a technical product requiring a precise installation operation depending on the customer; therefore, no warranty is available on this type of product.

Responsibility

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

Computing and freedom - GDPR

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing. Onamaste reserves the right to collect information about buyers, including through the use of cookies.
